saverinThe Charles Schumer and Bob Casey, the two U.S. Senators behind the Ex-PATRIOT act — a proposal to go after Eduardo Saverin and others like him that have renounced U.S. citizenship and are getting out of paying capital gains tax on stock windfalls — have now revealed the details of their plan. We first wrote about it earlier today when the offices of the two senators first announced their intentions. It’s pretty big: any ex-pat with either a net worth of over $2 million, or an average income tax liability of at least $148,000 over the last five years, “will be presumed to have renounced their citizenship for tax avoidance purposes.” The ex-pat will have to demonstrate to the IRS that this is not the case if it is not. If there is a “legitimate reason” for that person living outside the U.S. no penalties will apply. But if the IRS finds that someone gave up their passport for tax purposes, they will impose a tax on that individual’s investment gains “no matter where he or she resides.”

Virginia Republican delegate Robert Marshall says Tracy Thorne-Begland’s past activism makes him unfit to serve as a judge.

Law experts are taking issue with a Virginia legislator?s comment that ?sodomy is not a civil right? in explaining why he opposed a gay prosecutor?s bid to become a judge.

Virginia GOP delegate?Bob Marshall spearheaded the effort to block Tracy Thorne-Begland, an openly gay prosecutor in Richmond,?from becoming a judge, saying the attorney?s past activism and outspokenness on gay rights could bias his decisions on the bench.


The Virginia House of Delegates this week voted to reject Thorne-Begland?s bid to? become a general district court judge in Richmond.

Speaking Thursday on CNN?s ?Starting Point,? Marshall expounded on his reasoning.

?Dr. Martin Luther King and Rosa Parks never took an oath of office that they broke. Sodomy is not a civil right,? he said.

Marshall argued that Thorne-Begland?s past advocacy of gay rights would interfere with his neutrality on the bench, particularly in cases involving homosexuals. ?He can be a prosecutor if he wants to, but we don’t want advocates as judges,” Marshall said.

William Eskridge, a Yale Law School professor and author of ?Dishonorable Passions,? a book about the history of sodomy laws in America, rejected the contention that sodomy isn?t a civil right. He pointed to the U.S. Supreme Court?s landmark 2003 Lawrence vs. Texas decision, which struck down the criminal sodomy law in Texas ? and by extension, other states ? as unconstitutional.

?The Supreme Court ruled in Lawrence that anal or oral sex, commonly known as sodomy, when performed in private by consenting adults, is constitutionally protected –?which makes it a civil right,? Eskridge said.

Though the Lawrence case involved two gay men arrested for having sex in one of the men?s apartment, Eskridge noted that the protection applied equally to heterosexuals, since the overwhelming majority of cases of sodomy occur between men and women.

?The representative has the same civil right as the gay prosecutor,? Eskridge said of Marshall.

?That is something you have a constitutional right to do. Adults have that right without being subject to criminal punishment,? agreed Kim Forde-Mazrui, a University of Virginia School of Law professor.

Mazrui also took issue with Marshall?s suggestion that Thorne-Begland?s sexual orientation could hamper his impartiality as a judge.

?If you mean that people are always biased in favor of members of their own group then that would suggest that a straight male or a white judge could not be impartial in a case involving a crime between a straight and a gay person, a man and woman, or a white and black person –?which would render most judges and juries suspect by his conception,? Mazrui said.

?I think that kind of categorical presumption is misguided and there?s no support for that,? added Theodore Ruger, a law professor the University of Pennsylvania. ?Many judges — most famously judges like Thurgood Marshall and Ruth Bader Ginsburg –? were well-known advocates before taking the bench and they went on to distinguished careers.?

Thorne-Begland, a former fighter pilot who lives with his partner and two adopted children, came out as a gay Naval officer 20 years ago to challenge the military’s now-defunct “don’t ask don’t tell” policy, according to the Richmond Times-Dispatch. The announcement triggered his honorable discharge from the Navy. He has spoken out frequently on gay rights since then.

His boss, Richmond Commonwealth’s Attorney Michael N. Herring, has said Thorne-Begland ?would have been an outstanding judge.?

?It’s hard to think about what happened in the General Assembly and not conclude that it’s a form of bigotry,? Herring told reporters on Tuesday.

CAPS invites applications for 1 (one) Crisis Counselor (Full-time, Temporary Lecturer, 12 month). In collaboration with the Associate Director and Director of Counseling and Psychological Services, the Crisis Counselor will provide support, assessment and crisis management to students with emotional challenges and those whose behavioral difficulties impact the campus. The primary functions of this position require excellence in crisis intervention and case management. Additional functions require strong ability in other aspects of clinical service delivery including brief individual, couple, family and/or group counseling, intakes of students seeking services and limited psychological testing. Duties also include clinical services in the form of consultation and outreach services (i.e., psycho-educational programs) to various constituencies on campus (e.g., student organizations, faculty and staff), serving as a resource to university offices in an effort to enhance student life, and providing clinical supervision and training seminars for pre and post-doctoral trainees. Trainer gives his Derby-winning colt a day off

BALTIMORE (AP) ? Four days before the Preakness, I’ll Have Another trainer Doug O’Neill was feeling very skittish about his pending appearance on the grand stage.

His nervousness had nothing to do with saddling up the Kentucky Derby winner Saturday with the Triple Crown hanging in the balance. O’Neill didn’t care that it was too wet to send I’ll Have Another out on the track, and he certainly wasn’t uneasy about the Preakness coming down to another duel between his horse and Derby pace-setter Bodemeister.

No, the usually laid-back O’Neill was fretting over his assignment Tuesday night at Camden Yards: Throwing out the ceremonial first pitch before the game between the Baltimore Orioles and New York Yankees.

“I’d be lying if I said I wasn’t in my hotel room throwing shampoo bottles at pillows,” he said Tuesday morning. “My biggest thing is not bouncing it. The more people say don’t bounce it, the more likely you will bounce it. I’m just trying to stay focused on throwing it straight and strong and not embarrassing the I’ll Have Another team.”

He did a fine job. Standing in front of the mound, O’Neill peered for an imaginary sign from Orioles infielder Ryan Flaherty, who was poised behind the plate. O’Neill then went into an exaggerated windup and unleashed a high pitch that Flaherty snagged after leaping from his crouch.

O’Neill broke a trend by shipping the his horse to Pimlico Race Course just two days after the Derby, and he arrived in town two days after that. Since then, he’s been preparing I’ll Have Another for the Preakness and doing all things Baltimore.

O’Neill watched the Baltimore Ravens rookies practice last weekend and had lunch with coach John Harbaugh. On Monday night, he tried crabs for the first time.

“It’s a lot of work with a mallet. I felt like a carpenter,” O’Neill said. “It was good. We experienced the common food of Baltimore. I think next time I’ll look for the crab cakes. That’s the lazy man’s way of eating crab. Pulling the legs and cracking this and that, it does seem like too much work.”

On the topic of work, O’Neill decided I’ll Have Another didn’t have to do any Tuesday on a wet, dreary morning at Pimlico.

“With I’ll Have Another being as fit as he is and the fact he’s doing so good, we figured the weather forecast is supposed to be nice starting tomorrow, so why take him out there?” O’Neill said. “Like the rest of us, we all like a day off. We gave the whole barn a day off. He looks fantastic.

“You would expect good energy, which he has. We needed a lip chain to keep him on the ground. He was prancing around there. He’s happy. We’ll probably walk him a couple of more times throughout the day. He’ll probably be a little stir crazy without going to the track. I just thought it was the safest, smartest move.”

Since rallying past Bodemeister in the Derby, I’ll Have Another has showed absolutely no sign of fatigue. If the rousing run to the finish took anything out of him, it sure didn’t show in his appetite.

“Every morning we find a clean, licked-up feed tub,” O’Neill said. “He’s a really mellow horse in the stall. He’s a horse that every morning looks like he had a good night’s sleep.”

Many of the horses that ran in the Derby, including Union Rags and Hansen, have opted out of the Preakness. O’Neill, on the other hand, threw I’ll Have Another into the Preakness mix at the winner’s circle at Churchill Downs.

“You need a special horse to do it,” he said in front of Barn D at Pimlico, the temporary home of I’ll Have Another. “I could see where those guys probably want a little more time to recover. Fortunately, I’ll Have Another has recovered super quickly. It’s still going to be a tough race with Bodemeister and Graham Motion’s horse (Went The Day Well).”

Win or lose, O’Neill won’t soon forget this magical two-week stay in Baltimore ? even if he does bounce that first-pitch fastball at Camden Yards.

“The fact we get paid to do something we all love is incredible,” he said. “As friends and family come visit the barn, you can see how they just love the whole environment. We’re enjoying every minute of it. Who knows if we’ll ever be back again with a Derby winner? Hopefully we will be. We are just soaking it all in. We’re so blessed to have a brilliant horse like him.”

Raising Healthy Beef For Growing Families | Montana Farm Bureau …

Brady and Tonya Liles ranch north of Terry in eastern Montana. The Liles family started out in Iowa, then moved to North Dakota where they raised and sold horses to the U.S. Calvary. In 1915, Brady?s great-grandfather moved to Montana and purchased a ranch where he raised horses and Hereford cattle. In the early 1900?s, Herefords were the most popular and common cattle type raised in Montana.

Over the years, the family purchased more land, including the ranch on which Brady and Tonya currently reside. They eventually phased out their horse business and switched to raising cattle and farming small grains such as wheat.

In the 1960?s, Brady?s grandpa and great uncle were some of the first ranchers in the area who started purchasing Black Angus bulls and crossing them with their Hereford cows. They also purchased and added Black Angus heifers to their herd, transforming it from being almost exclusively Hereford, to a predominantly Black Angus very quickly. By the time Brady?s father operated the ranch, the ranch had mostly Black Angus cattle.

Brady grew up on his family?s ranch, graduated from high school in a nearby town and attended college. He was only 18 credits short of earning his bachelor?s degree when his family?s hired man, also known as a ranch employee, quit and Brady returned home to the ranch to help his parents. His father suffered from Lou Garhig?s disease for nine years before passing away, leaving only Brady, his mom, sister, and younger brother who was still in high school, to run the ranch. Brady returned to the ranch full time when he was only 22 years old and began running it independently.

Tonya grew up on a ranch east of Miles City in eastern Montana. Her family arrived in eastern Montana a little differently than Brady?s. Tonya?s grandmother, a first generation American whose parents immigrated into the United States from Germany, worked for Boeing during World War II and her grandfather, a Nebraska farm boy, was enlisted and deployed during the War. They met and married after the war, then moved to eastern Montana (where Tonya?s grandmother is originally from) and bought a ranch. They raised four children, including Tonya?s father, on the ranch. All four of their children and their families raise cattle on nearby ranches to this day.

Tonya developed a passion for animals at a young age so it is no surprise that when she graduated high school, she obtained a degree in agricultural business and a veterinary technician?s degree. She moved back to her hometown and worked at the large animal veterinarian?s office and with her parents on the family ranch. She even had her own herd of cattle and several horses.

Brady and Tonya never met until they were both adults, even though they grew up less than 100 miles apart. When they finally did meet, they realized they had a lot in common, including their passion for the cattle business. They were married in 2010 and Tonya and her cattle moved out to Brady?s ranch. Today, they raise Black Angus and Hereford cross cattle, meaning their cattle are part Angus and part Hereford. Brady decided to bring Hereford genetics back into his herd a few years after his return to the ranch which is a good thing because Tonya has always been a fan of Herefords.

As you can see from their picture, Tonya and Brady recently started their own family and their daughter Kinley was born last summer. Not only is Kinley the 5th generation Liles to live on the family ranch, she is also already a 5th generation cattle owner. Brady and Tonya bought Kinley her own brand and bred heifer (pregnant yearling female who has not yet calved) last fall. ?She is only 8 months old and she already likes to try to pet the cows,? Tonya explains.

Brady and Tonya strive to provide their animals with the best possible care. ?It?s not like we just turn them out in the pasture and forget about them,? says Tonya. ?We spend an incredible amount of time checking their health, making sure their nutritional requirements are met, moving them to pastures with the best grass and water sources, putting up hay for winter feeding, and that?s just in the summer! Sometimes I?m afraid we take better care of them than we do ourselves.? The area they live in has very long, often cold and snowy winters. ?We feed a lot of hay and plow a lot of snow,? Brady explains. ?The winter pastures provide the cows with places to get out of the wind, but we plow snow so they have a place to lay down if necessary and we feed them lots of hay so they can easily maintain their weight and stay comfortable. It takes a lot of hay to do that when it?s cold, but it?s our job and we?re glad to do it!?

In addition to thinking about the well-being of their cattle, Tonya and Brady are always thinking about their customers. ?We want to raise the healthiest, highest quality, most consistent and delicious product for our customers because we want them to keep eating beef. ASUS PadFone’s real world battery life: 14.1 hours of 3G browsing in laptop mode

Since the official launch at MWC, ASUS has been mum on how many hours its upcoming PadFone can stay on the treadmill for, but earlier today, we spotted an official promotional video — which has since been removed from ASUS’s YouTube channel — that mentioned 16 hours of battery for the phone itself, 63 for tablet mode and 102 for laptop mode. Something smells funny here so we pinged ASUS, and guess what? Those turned out to be just continuous talk time over 2G, so perhaps said video clip was pulled to be re-edited.

Conveniently, ASUS was also kind enough to share some very realistic battery life figures from the lab. With the corresponding screen set to 137 nits (about half the brightness), you get the following for phone mode, tablet mode and laptop mode, respectively: 2.6 hours, 10.7 hours and 17 hours of continuous WiFi browsing; and 2.1 hours, 8.9 hours and 14.1 hours of continuous 3G browsing. Just as promised before, the PadFone Station (the tablet) and the PadFone Station Dock (the keyboard) do seem to pump up the battery by about five-fold and nine-fold max, respectively.

Now sure, these may make the 1,520mAh battery inside the phone look feeble and silly, but do bear in mind that these aren’t the “up to” numbers. As always, stay tuned for our own tests whenever the PadFone finally lands on our doorstep.
